RENTAL AGREEMENT / TERMS

TRAVEL NOTICE

COVID-19 Alert: Resort and region may have limited services and amenities, and may require face coverings, social distancing and temperature checks.

COVID-19 RISK

IMPORTANT: The coronavirus (COVID-19) pandemic is now considered a foreseeable risk. By digitally signing this agreement, the Renter hereby acknowledges and accepts the risk that the pandemic may prevent or restrict their ability to travel or occupy the rental unit. Renter accepts pandemic-related cancellations will not serve as a basis for requesting an exception to the cancellation policy or penalties. However, if the Resort itself is closed or refuses to honor the reservation, unit shall be considered uninhabitable, and the Owner and Renter agree to the uninhabitable unit policy listed below.

CANCELLATION POLICY

 If Renter cancels at least 60 days prior to check-in, 50% of the total rental amount will be retained by the Owner as a cancellation penalty. For cancellations less than 60 days prior to check-in, the penalty is 100%.  Absolutely no refunds or exchanges will be given less than 60 days to check-in unless the unit can be rented to someone else. You will be refunded whatever we can get for the week minus any costs to advertise the unit.


Renter's inability to complete their travel for any reason beyond the Owner's control (including, but not limited to, illness, airline interruptions, job loss, state or local government mandate or restrictions) are the sole responsibility of the Renter, and the Cancellation Policy applies. Renter is encouraged to purchase trip interruption and cancellation insurance for such matters. 



DEPOSIT

Renter will pay a deposit of 50% of the total rental amount. The deposit is required to reserve your week with the Owner. This deposit is NEVER refundable unless the unit can be rented to someone else.  You will be refunded whatever we can get for the week minus any costs to advertise the unit. 

FULL PAYMENT

Payment of 100% of the rental amount is due within 60 days of check-in.  Unless prior arrangements have been made in writing, your reservation will be cancelled and you will forfeit any deposits paid to the Owner. 

TERMS AND CONDITIONS

  

  • Renter agrees to use the Unit in accordance with all resort rules and regulations, including occupancy restrictions, pet and smoking policies, noise/nuisance, and check-in and check-out policies. Renter and guests are responsible for all personal property brought to the resort, and will observe all rules and warnings provided at check-in and posted throughout the Unit and resort grounds, including pool and hot tub usage. 


  • Renter is responsible for payment of all costs for goods, services and activities for which additional fees apply. Renter will be solely responsible for any housekeeping or other      services provided to Renter or guests for which there is an additional charge, and any other extra fees imposed by the resort for services or for the use of its facilities. Some resorts charge local lodging taxes or resort fees which are the responsibility of the Renter. 


  • Renter agrees to maintain the Unit in the same condition as it was at the start of the Rental Period. Renter will pay for all repairs, replacement, and damages resulting from the act of neglect of Renter and guests. If requested at time of check-in, Renter will provide a credit card to the resort to secure payment for any such deposit, repairs, replacements, or damages.


  • The Owner is not responsible for any inconvenience, unavailability, or interruption of services due to repairs, improvements, on-site construction, amenity closures, reasonable resort substitutions (specific unit, bed types, etc.), or for any other reason beyond the Owner's control. Owner is responsible for providing Renter with reasonable notice of any such inconveniences of which Owner becomes aware. 


  • Renter will be required to present a major credit card at check in for security deposit in the following amounts:  2 Bedroom units require 600 USD deposit. 1 Bedroom units require 400 USD deposit. Hotel units require 200 USD deposit.  The deposit is NOT required for Royal Resorts Members.


  • Renter may not sublease the Unit or re-assign this Agreement without explicit written consent from the Owner.


UNINHABITABLE UNIT

 If the Unit is uninhabitable or inaccessible on the day the Rental Period commences by reason of closure for pandemic related Mexican Government Restrictions, the Renter will be given a replacement week (based on availability) for future travel at little or no charge. Typical charges range from $89.50 - $239 per unit per week. Renter's inability to complete their travel for any other reason beyond the Owner's control (including, but not limited to, illness, airline interruptions, job loss, state or local government mandate or restrictions) are the sole responsibility of the Renter, and the Cancellation Policy applies. Renter is encouraged to purchase trip interruption and cancellation insurance for such matters.
